1. Agreement to Terms

By accessing or using the Genesis Platform ("Platform") provided by Mr. NeC B.V. ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

Genesis is a Sovereign Operational Intelligence platform that provides:

• Multi-agent orchestration and coordination
• Organizational memory and knowledge management
• Sector-specific operational intelligence solutions
• Personal cognitive operating environments

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Data Sovereignty

4.1 Your Data Ownership

You retain full ownership of all data you input into the Platform. Genesis operates on a principle of data sovereignty—your organizational memory belongs to you.

4.2 Data Portability

You may export your data at any time in standard formats. We do not lock you into our platform.

4.3 No Data Mining

We do not access, analyze, or monetize your data for any purpose other than providing the services you request. Platform improvements are driven solely by your direct feedback.

5. Pricing and Payment

5.1 Subscription Fees

Fees are as described on our Pricing page. We reserve the right to change pricing with 30 days notice.

5.2 Success Fees

Certain plans include success-based fees tied to measurable outcomes. These are calculated according to the specific terms of your service agreement.

5.3 Refunds

Subscription fees are non-refundable except as required by law or as specified in your service agreement.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to any systems
• Interfere with or disrupt the Platform's operation
• Reverse engineer or attempt to extract source code
• Use the Platform to develop competing products

7. Intellectual Property

The Platform, including its software, design, and documentation, is owned by Mr. NeC B.V. and protected by intellectual property laws. Your use of the Platform does not grant you ownership of any intellectual property rights.

8. Limitation of Liability

To the maximum extent permitted by law, Mr. NeC B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

9. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

We may terminate or suspend your access to the Platform at any time for violation of these Terms. Upon termination, you may export your data within 30 days.

11. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Rotterdam, Netherlands.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Platform.
